2. Scope of this Privacy Policy

For ease of reading, we will describe the Privacy Policy as "this Policy" or "this Service" below.The name difference will not cause any change in the content.

This policy only applies to the data we collect from you through the platform and does not apply to any products, services, websites or content provided by a third party or with its own privacy policy.

3. Our principles for collecting data

For the data we collect, we will follow the principles of legitimacy and necessity to collect and use the personal information you voluntarily provide to us and the personal information we automatically collect from third parties during your use of PingChat: liveStream and services. If we need to use your information for other purposes not specified in this policy, we will notify you in a reasonable manner and use it with your consent (when required by applicable data protection laws).

About the information you voluntarily provide

  1. About your account information: When you register an account, we will collect the information you provide (including but not limited to mobile phone number, Facebook, Apple, Google Play, etc.) according to the registration method you choose.
  2. Personal profile information: We will collect your personal profile information according to the login method you choose, including the avatar, user name, gender, date of birth, country/region, etc. of the third-party login you choose.
  3. Platform activities and other related information: When you need to participate in an event organized by us or a company or third party affiliated with us on the platform, we may ask you to provide your name, gender, mailing address, contact information and bank account information. If you refuse to provide this information, it may affect your participation in the related activities but will not affect your normal use of PingChat: LiveStream.
  4. Room information: When you create a chat room, we may collect the chat room information you created, including (cover, name, announcement, country).
  5. Message information: When you send messages to others in PingChat: LiveStream, we may collect the information you provide, such as the message content, sending time, receiving time, and recipient. Of course, we will protect your data and will not cause any risk of leakage.
  6. Follow information: We will collect information about the users you follow and the other party.
  7. Feedback information and identity proof: When you use PingChat: LiveStream to provide feedback, we will collect the information you provide to us (if you provide image information, we will save the relevant image). In some special cases, we may ask you to provide your real identity information to verify your identity.

We also automatically collect and store the following data when you use our products:

  1. During your use of our platform and services, your device ID, user ID, operating system version, device model, device type, operator name, network type, client version number, language setting, IP address, SIM card country/region, registration time, login time, and records of your use of services, such as the date and timestamp of the operation.
  2. We may collect information about your use of the platform, including but not limited to your interaction information on the platform, your interaction information in the chat room (including the chat room you join and the length of time you stay in the chat room), information about the activities you participate in, etc.
  3. When you use our voice chat service to chat with others, we will not retain the relevant data of such voice chat on our servers. Our servers will distribute this data to your intended recipients by means of relay.
  4. When you use our text chat service to chat with others, we will not retain the relevant data of such text chat on our servers. Our servers will distribute this data to your intended recipients by means of relay.
  5. When you send pictures, we may collect the pictures you send and save them for 3 days to prevent violations of platform regulations and laws and regulations.
  6. When you make any transactions through the iOS App Store or Google Play, in order to maintain your transaction records, we may collect information (including Open ID and user information fees, currency, purchased items, purchase history, IP address, transaction details and device details, such as operating system version, mobile phone model or device type and Internet connection);
  7. When you publish, share, upload or otherwise disclose any information (such as your avatar, your nickname, your gender, etc.), we will collect such information for sharing your content with other users, for developing new services and improving existing services and applications to ensure and enhance your experience in the application.
  8. When you use the feedback service function to handle problems you encounter when using the application, we may collect some information, including OpenID, device ID, device available space, network type, operating system version, platform, operator, country/region code, email address, etc., so that we can promptly discover and solve the problems you report.
  9. We may access the content in your device clipboard, including text, pictures and videos, with your permission, so that you can quickly input the content you copied.
  10. To ensure the safe operation of the software and services, we will collect your device model, device name, device ID (including IMEI, IMSI and Android ID), settings, language settings, operating system version, application version, network device hardware address, login IP address, network access method, network quality data, mobile network information (including operator name) and product version number. To protect your account from malicious use by other users, please understand that we will dynamically detect whether your account has abnormal logins. Every time you switch or restart the application, we may re-read your device ID information. We will control the reading frequency within a reasonable range.
  11. When you use our platform and services, in order to ensure the user experience of you and other users on our platform, our security and anti-cheating functions will analyze the user's device status to identify security risks and cheating behaviors; detect whether your signature, pictures, user names or chat records contain malicious information. Please understand.
  12. In certain managed areas, we may collect your location data and mobile device location information with your consent. If you choose not to share your location, you can turn off location-related services through the settings on your mobile device. If you refuse to provide such information, you will not be able to use location-based services, but it will not affect your use of other features. If you want to turn on the service, just turn on the location service in the same location.
  13. When you report any issues or make inquiries about our platform and services, for the security of your account and system, we may ask you to provide relevant personal information to match the personal information you previously provided to verify your identity. After successful verification, we may collect information when you communicate with us (account information, order information, and related information such as pictures/videos/text information you provide to prove relevant facts), your contact information, and records of your communication with us, including online communication records, so as to solve your problems as soon as possible and improve our products and/or services.
  14. To ensure that you can maintain instant communication with the backend server and receive personalized content push in a timely manner when using the PingChat: LiveStream service, we will obtain and call your startup broadcast permission to start the mobile client software of PingChat: LiveStream or its affiliates; use a third-party push message service to generate an ID for you to uniquely identify your device.
  15. In order to train and improve our technology, such as our machine learning models and algorithms, we may use the collected information for internal operations, including troubleshooting, data analysis, testing, research, statistics and survey purposes, and to solicit your feedback. In order to maximize the protection of your data, we will reduce the use of information related to you. In some cases, we will de-identify or aggregate the information, or anonymize it so that it can no longer identify you.
  16. In the process of providing you with services, some of your device permissions may be invoked. You can choose to turn off some or all permissions in the settings of your device. After the permissions are turned off, some functions may become unavailable (depending on the permissions you have turned off).

Use of Your Information

We will use your personal information to operate, provide, develop, and improve the Platform and Services, subject to your consent, to perform contracts between you and us or third parties, to comply with our legal obligations, or to pursue our legitimate interests or those of third parties (as applicable), for the following purposes:

  1. To provide our Platform and Services, including enabling you to communicate with other users on our Platform.
  2. To enforce our Terms of Use, Community Guidelines, and other policies that apply to you.
  3. To enable you to interact with Virtual Goods.
  4. To understand how you use the Platform, including across different devices.
  5. To obtain other information about you, such as your age, gender, and interests.
  6. To ensure the secure operation of our Platform and Services and protect them from attacks.
  7. To communicate with you, provide customer service, and provide us with feedback.
  8. Conduct research, analysis, and investigations about our Platform and Services.
  9. Improve and develop the Platform and Services.
  10. Prevent and combat abuse, fraud, illegal activities, and other potentially harmful content.
  11. Ensure that content is presented in the most effective manner for you and your device.
  12. Identify security and fraud risks.
  13. Train and improve our technology, such as our AI learning models and algorithms.
  14. Comply with our legal obligations or, if necessary, perform tasks in the public interest or protect the vital interests of users and others.In accordance with applicable laws and regulations, we may collect and use certain necessary personal information without your authorization and consent in the following circumstances
  15. Information related to compliance with our legal obligations;
  16. Information directly related to national security and defense;
  17. Information directly related to public safety, public health, and other vital public interests;

  23. Information necessary to maintain the security and operational stability of our products and/or services: used to detect and resolve product or service failures and address related issues;

4. How We Share, Transfer, and Publicly Disclose Your Personal Information

Sharing with Service Providers

We engage other companies, agents, or subcontractors ("Service Providers") to perform services on our behalf or to assist us in providing services to you. For example, we engage Service Providers to provide marketing, advertising, communications, security, infrastructure, and IT services; personalize and customize our Services; provide customer service; analyze and improve information (including information about users' interactions with our Services); and to process and administer consumer surveys. Cloud Service Providers: To provide services to users worldwide, we select cloud service providers with high-quality privacy and data protection capabilities, including storage service providers, technical service providers (including content review services, real-time communication services, email and/or messaging services, network acceleration, and security services), and other cloud service providers.

Content Review Service Providers

To ensure the security of content posted by users on our online information platforms and to ensure compliance with local regulatory requirements, we may share the information you post on the platforms with our designated third-party content review service providers.

Customer Service Providers

We may use customer service providers to provide customer service and manage our community. Third-Party SDK Providers: When using third-party features on PingChat: liveStream, we may access SDKs provided by these third parties to implement these features. We restrict access to SDK service providers through partnership agreements. However, third-party SDK providers may collect your personal information. The collection and processing of information by these service providers is subject to their own privacy policies, which do not apply to this Policy. To maximize the security of your information, we recommend that you review the privacy policies of third-party SDK services before using them.

Sharing with Third Parties

We hope you understand and appreciate that, in order to provide you with more comprehensive and quality products and services, we authorize our business partners to provide specific services. In these cases, we may share some of your personal information with our business partners to provide better customer service and a better user experience. Please be aware that we will only share your personal information for legitimate, necessary, specific, and explicit purposes, and only to the extent necessary to provide the services. We will conduct security assessments and process data output, flow, and use to ensure its security. We will closely monitor and manage our business partners. If we learn that they are using your personal information in violation of our policies, we will immediately terminate our partnership and comply with our legal obligations.

Our Business Partners. We will only share this information with our business partners or third parties with your consent or as permitted by applicable law to ensure a consistent service experience throughout your use.

Your Friends. If you become friends with certain users on our platform, they may be able to see the spaces you create and/or join.

Other Third Parties: You may share your personal information or any other information with third parties (including anonymous parties) on the platform at your discretion. However, we are not responsible for any disclosure, use, or other actions related to such information that may result from your sharing.

Public Disclosure

Public disclosure refers to the process of communicating information to the public or an unspecified group of people. We generally do not disclose your personal information publicly. However, the following exceptions apply:

  1. We will display required information (with appropriate sensitivity) when announcing winners and notifying penalties;
  2. Your profile information will be publicly disclosed (including your username, avatar, profile, age, level, country, number of visitors, number of users you follow, number of fans, badges, rooms you follow, preferred language, star groups, hashtags, and gifts you receive).
  3. When you create or join a chat room, your profile (including your username, avatar, and room status) and your chat behavior (including messages sent in the room and voice conversations you participate in while in the room) will be publicly disclosed. However, if the chat room is set to "private" using a room key, this information will only be disclosed to the user who joined the room or to users of our affiliates' products and services. The status of your room and any rooms connected to it will be publicly disclosed, but you can choose who to share it with.

Data Transfer

The term "data transfer" refers to the transfer of your personal information to another company, organization, or person. We will not transfer your personal information to another company, organization, or person unless we have your express consent. However, the following exceptions apply:

  1. We have previously obtained your consent;
  2. You have provided your consent;
  3. In the event of a merger, acquisition, or bankruptcy, this may require the transfer of your personal information. In such cases, we will notify you and require the new company, organization, or person holding your personal information to continue to comply with this policy. 5. Age Restrictions and Parental/Guardian Controls

PingChat: Live stream is not intended for children under the age of 13 (or the age of majority according to applicable law in the user's country/region) ("Children"). In some cases, this age may be higher due to local regulatory requirements. For more information, please refer to the relevant section of the Terms of Service for specific minimum age restrictions and requirements listed in your jurisdiction under "List of Applicable Regions".

Unless other age restrictions are specified in applicable law in the user's country/region, children permitted to use our Platform and Services under local law must carefully read the following terms with their parents and obtain prior consent and agreement to this Policy from their parents/guardians (on behalf of the child and guardian).

We will not knowingly collect any personal information from children without such consent and agreement. Here, parents/guardians should only decide whether to accept or reject this Policy after fully understanding it:

  1. Users under the age of 16 (specifically, those under the age of 13 or under the age of majority according to the applicable law in the user's country) should read all the terms of this Policy and use the relevant Pingchat: LiveStream Services under the supervision, guidance, and consent of their parents.
  2. We place great importance on protecting the personal information of minors. Minors should increase their awareness of personal safety and exercise caution when providing their personal information. Please use Pingchat: LiveStream Broadcasting Services appropriately under the supervision of your administrator.
  3. We will ensure the privacy and security of minors' information in accordance with applicable laws and regulations and the provisions of this Policy. If we discover that we have collected personal information about minors without the prior, verifiable consent of their parents or legal guardians, we will delete the relevant data as quickly as possible. If you are responsible for a minor user, have questions about the use of our Services or user information provided to us by a minor user under your care, or believe you are a minor user, please contact us as soon as possible using our contact information.

6. How do we use cookies and similar technologies?

PingChat: LiveStream uses cookies to provide more personalized and tailored services, including promotional services.If you do not disable cookies and similar technologies (hereinafter referred to as "cookies"), PingChat: LiveStream will set or access cookies on your mobile device to enable you to log in or use PingChat: LiveStream services or cookie-based features.

You have the right to accept or decline cookies. However, if you choose to decline cookies, you will not be able to use PingChat: LiveStream services or cookie-based features. You can decline cookies by changing your browser settings or managing cookies on your mobile device. This policy applies to information collected through cookies placed by PingChat: LiveStream.

7. Special Note Regarding Use of Third-Party Products/Services

PingChat: Live Stream may contain links to third-party products and/or services, or information and/or services. Your use of these services (including any personal information you provide to third parties) is subject to the third-party's terms of service and privacy policy (excluding this Policy), which you should read carefully and decide whether to accept.

Protect your personal information and only share it with third parties when necessary.

This Policy applies only to the information we collect, store, use, share, and disclose; it does not apply to services provided by third parties or any of their information use policies.

Third parties are solely responsible for their use of your information.

8. How we store and protect your personal information

Information Security

To protect your personal information, we will make every effort to implement a variety of security measures consistent with industry standards to reduce the risk of damage, misuse, leakage, unauthorized access, disclosure, and alteration of your personal information. We will actively implement data classification and sorting systems, data security management standards, and data security enhancement specifications to manage and regulate the storage and use of your personal information, and we will ensure that personal information unrelated to our services is not collected.

If we cease operations, we will immediately stop collecting your personal information, provide you with notice of termination in the form of a service or announcement, and delete or anonymize your personal information in our possession.

Information Storage and International Transfers

Your personal information cannot be processed on servers in your country of residence. Our support, development, and other global teams may also access your information from locations outside your country of residence. Regardless of where our servers are located, we will take appropriate measures to protect your rights and interests in accordance with this Privacy Policy.

Our Platform Services servers are located in Singapore.

If your personal information is transferred to another country/region, we will inform you via system message or email about the purpose and recipients of your personal information (if required by the data protection laws and regulations of your country/region) and obtain your consent and approval (if required by the data protection laws and regulations of your country/region). Information Deletion

You can delete your account through our official website (https://www.pingchatlivestream.top/confirm-account.html) or in-app settings - Account Security - Logout. Please note that when you choose to delete your account on our official website, you will need to log in to verify your account. If you forget your username or password, you can log in to the PingChat: LiveStream APP to find it, or use our feedback function to solve the problem. Currently, not all account types support deletion through the website. If you cannot delete your account through the website, please log in to the App or contact our customer service at [email protected].

After your account is deleted, your personal information will be deleted from PingChat: LiveStream, except for personal information that we must retain as required by law (for example, information related to your transactions on PingChat: LiveStream, and data that the government or law clearly stipulates should be retained).

Objection

Some jurisdictions may give you the right to object to our processing of certain personal information. You can exercise your right to object by contacting us as described in the "How to Contact Us" section of this policy.

Complain to a supervisory authority

You have the right to complain to the supervisory authority responsible for data protection.
